“Pelo exposto, DEFIRO A TUTELA DE URGÊNCIA, para: a) suspender o prosseguimento do REEF (ATOrd 0010745-06.2014.5.01.0031); b) suspender a execução da garantia apresentada no PEPT; c) suspender toda e qualquer medida constritiva naqueles autos em desfavor do Requerente, até ulterior decisão acerca da concessão do Regime Centralizado de Execuções, nos moldes da Lei 14.193/2021; e d) determinar ao clube requerente efetuar o depósito judicial, como requerido na peça de ingresso” – conclusão da decisão desta quarta-feira.

O vice jurídico do Vasco, José Cândido Bulhões, analisou a decisão da desembargadora e disse que o Vasco irá elaborar um plano de pagamento dos credores e buscar dar conta de todos os seus pagamentos previstos na lei. Ele ressaltou que a decisão foi importante para o futebol brasileiro como um todo, já que coloca uma decisão que ajuda os clubes a resolverem seus problemas e endividamento.

– A decisão é muito importante em vários aspectos. Primeiro que ao suspender a execução de R$93,5 milhões permite que o clube pague os salários, seus fornecedores e obrigações correntes. Além disso, ela cria as obrigações necessárias para que o clube elabore o plano de pagamento dos credores previsto na lei 14.193 permitindo assim que o clube siga em frente com a centralização das execuções conforme o requerido a presidente do tribunal – disse, e em seguida explicou:

– Na semana passada, o Vasco teve requerido o direito da centralização das execuções com base na lei 14.193, mas só isso não bastava. Era preciso que suspendessem a execução forçada de mais de R$ 93 milhões porque isso inviabilizaria até mesmo a elaboração do plano de pagamento dos credores. Afinal, como o clube vai montar um plano par apagar seus credores, se ele foi executado de R$93 milhões. Ficaria inviável – acrescentou, e emendou.

– Havia também uma penhora de R$ 24 milhões do contrato com a Globo que é a maior fonte de receita do clube no momento. Então, essa penhora na Globo por si só já comprometia o funcionamento do clube das obrigações correntes do clube. Então, a decisão foi importante, pois o clube consegue programar o pagamento de forma organizada sem comprometer o funcionamento do clube. Com a decisão de hoje, ficam suspensas todas as decisões em curso e o Vasco passa a destinar 20% de sua receita mensal corrente para o plano de pagamentos para o pagamento de credores apresentado – finalizou.

Após o Vasco ser excluído do Ato Trabalhista, o gestor de centralização do TRT-1, Fernando Reis de Abreu, pediu ao clube o Regime Especial de Execução Forçada (Reef). Com isso, cobrou R$ 93 milhões em dívidas trabalhistas com ex-funcionários. O clube inicialmente tentou suspender essa decisão, porém o pedido foi negado pela desembargadora.

No dia 10 de agosto, a direção do Gigante da Colina fez o pedido de instauração do Regime Centralizado de Execuções (RCE), algo previsto na nova lei brasileira voltada ao clube-empresa. Por meio dela, os clubes têm direito de realizar uma centralização das cobranças visando evitar algum tipo de penhoras individuais e fazer o pagamento em no máximo seis anos com o repasse de 20% da receita mensal. O clube criticou a decisão da justiça na época.

Na época,a desembargadora Edith Maria Correa Tourinho, presidente do Tribunal Regional do Trabalho da 1ª Região, reconheceu o direito do clube em centralizar a execução de todas as suas dívidas trabalhistas. A magistrada também definiu um prazo de 60 dias para que o Cruz-Maltino apresente um plano de pagamento. Dessa forma, o Vasco terá dentro de 60 dias para apresentar um plano oficial de pagamento para que a magistrada analise e decida a sua validade.

We're prepared to take stick for this but it appears like Bellingham might, perhaps, be the best goalscorer, more creative and crisper in possession too, but Rabiot has occupied more of a box-to-box role than his English counterpart, who has effectively performed as a box-crashing forward for much of the campaign.

But still, Rabiot holds his own in accuracy in both his ball-carrying and duel success rates, proving to be more active and energetic and still creating six big chances to Bellingham's seven despite their positional differences. You can look back at certain moments during the campaign and wonder what if. What if they had beaten Aston Villa during the run-in? Well, what if they'd beaten Man City during the same run of games too?

The fact of the matter is that Arsenal probably did just about all they could to win the title. They had the best defence in the land and were scoring goals at will, smacking six past West Ham, five past Burnley and another half a dozen past Sheffield United.

Is scoring more goals the answer, then? It feels ridiculous to say yes after the facts listed above but they still found the net fewer times than the might of Pep Guardiola's team.

So, how about a new striker?

The strikers Arsenal could sign

RB Leipzig forward Benjamin Sesko was linked rather relentlessly with a move to Arsenal a few weeks ago but he is now set to stay in Germany and sign a new deal.

The next target they have moved onto is believed to be Viktor Gyokeres of Portuguese club Sporting.

Gyokeres had a wonderful campaign in Lisbon, scoring 43 goals across all competitions with some reports even suggesting the Gunners are closing in on his acquisition.

That said, with such a hefty price tag attached to him – £76m upfront reportedly – there are questions to be asked about whether the club need a new centre-forward.

After all, Kai Havertz shone as a false nine during the back end of last campaign, contributing to 15 goals in 18 matches from that role.

So, would landing Gyokeres, someone who has never played in the Premier League before be a gamble? Indeed.

Perhaps raiding a top-flight club again, a successful tactic during the Edu and Arteta reign would be a good idea.

Let's get things straight. The idea of Aston Villa selling their main man ahead of a season in the Champions League is unlikely.

However, the England international has been on the club's radar for a while now and is a self-confessed Gooner. Perhaps the stars will finally align this summer?

Speaking in 2020 when he was still a Brentford player, he said: "That’s the dream, to play for Arsenal one day. But, you know, it’s a long shot."

The latest we heard on any move was back in March when reports suggested that Arsenal had made an approach to sign Watkins, a player reportedly valued around the £75m mark.

So, he could cost the same amount as Gyokeres this summer, but they'd be getting a Premier League-proven player who is in the best form of his life.

Speaking on Monday Night Football last season, presenter Dave Jones suggested that he was delivering "Thierry Henry style numbers".

Why did he say that? Well, the Villa star was as good in front of goal as he was creatively.

CSA’s members’ council have u-turned on their decision not to recognise the nine-member interim board imposed by the country’s sports minister, Nathi Mthethwa, and have agreed to ratify the temporary body. That means CSA will avoid a sanction from Mthethwa, which could have resulted in it being stripped of status as the governing body of cricket in South Africa, and having its funding withdrawn.In the immediate term, it ensures the national men’s series against England, which starts on November 27, is safe. England are due to arrive in South Africa on Tuesday to begin a 10-day quarantine period. Though the tour was green-lit by government, uncertainty over CSA’s status meant that there were some concerns the administrative bungling could have on-field effects.ALSO READ: Buttler targets momentum in England’s T20 World Cup build-upAs long as the interim board is formally recognised (which should happen in the coming days in accordance with the Companies’ Act) and Mthethwa is not needed to intervene again, series against Sri Lanka, Australia and Pakistan will also be able to go ahead as planned, while the women’s team’s schedule is also expected soon.While CSA has escaped ministerial interference, the board may not be out of the international spotlight. The members’ council, or any other department of CSA, could yet lodge a complaint with the ICC, citing government interference over the interim board, which could result in further action. Mthethwa has kept the ICC abreast of all his communication with CSA and interim board chair Zak Yacoob, who remains in his position, has made plain that the sports minister’s action does not constitute a breach of ICC code of conduct as it aimed not at running cricket, but stabilising it. It is not clear what caused the members’ council’s change of heart apart from the obvious: that they had no choice but to work with the interim board or face the wrath of government and a massive backlash from the most important stakeholders, the players and fans. The South African Cricketers’ Association made known its “despair” that the members’ council had initially stymied the interim board, and over the weekend, two current cricketers, Farhaan Behardien and Henry Davids implored them to “look after the future generation of players”.For that to happen, the work of the interim board needs to progress swiftly. The board was given an initial three-month period, which will run through to the end of January, to look into a wide-range of issues including a proposed domestic restructure and the forensic report which CSA used to fire former CEO Thabang Moroe, and to design a roadmap for CSA to elect a new, permanent board after its yet-to-scheduled AGM.The magnitude of their task means the interim board require ease of access to information from CSA but they have been obstructed over the last two weeks, which could result in their stay being extended. Reliable sources confirming that the CSA executive have not been willing to supply information to the interim board . Yacoob himself said that “those members of the administration who we have interacted with have been uncooperative, difficult, unresponsive, arrogant and sometimes rude”. Crucially, the members’ council also believed the interim board should report to them, something which Yacoob clarified is not the case. “This is not the type of board that can be placed under anyone’s thumb,” Yacoob said, stressing the independence of the interim board.
