Court drops charges against Sreesanth, Chavan and Chandila

Charges against Sreesanth, Ankeet Chavan and Ajit Chandila, who had been chargesheeted by the Delhi Police for the IPL 2013 corruption scandal, were dropped by a trial court in Delhi on Saturday. The court’s decision, however, did not have an impact on the life bans imposed by the BCCI on Sreesanth and Chavan. The three were among 42 individuals released by the court on grounds of lack of sufficient evidence for prosecution under the Maharashtra Control of Organised Crime Act (MCOCA).The three cricketers were arrested in May-June 2013 for their alleged involvement in betting and spot-fixing during the IPL. While Sreesanth and Chavan were granted bail within a month, Chandila had to spend more than three months in prison before he was released on bail. The BCCI banned Sreesanth and Chavan in September 2013, while Chandila’s case is pending before the board’s disciplinary committee.

Civil consequences will continue to affect cricketers

Suhrith Parthasarathy, a lawyer told ESPNcricinfo that the trial court’s decision would have little impact on the ‘civil consequences’ faced by the cricketers.
“They were charged under a law that was meant to deal with organised crime in Maharashtra and the charges have been cleared because the prosecution was unable to produce before the court sufficient evidence to prove their charges,” Parthasarathy told ESPNcricinfo,”In criminal law, the kind of evidence the prosecution needs to bring to court is a kind of evidence that shows beyond reasonable doubt that these individuals had committed the offences under the MCOCA. Obviously the Delhi Police was unable to do it in this case and therefore the court has cleared them of all these charges. This does not mean that the other civil consequences that Sreesanth and the other cricketers would face follow. Those would continue to apply.
“Obviously Sreesanth and the others will try and go to the BCCI and say, look the criminal court has cleared us of charges now you also overturn the life ban. The BCCI can still say that under our regulations, we believe you have committed spot-fixing. The balance of probability shows that you have committed the offence and therefore we are not overturning the life ban.”

With the absence of a specific criminal law to deal with spot-fixing in India, the cricketers were chargesheeted for offences under the Indian Penal Code and provisions of the MCOCA. The court, however, said there was not enough evidence for charges to be framed under the MCOCA, a special law passed by the Maharashtra state government to tackle organised crime syndicates and terrorism which contains far stricter provisions relating to bail and admissibility of confessions compared to the Indian Penal Code.In its reaction to the court’s decision, the BCCI said its disciplinary action would remain unaltered. “Any disciplinary proceeding or decision taken by the BCCI is independent to any criminal proceeding and has no bearing. The decisions of the BCCI, based on its independent disciplinary action, shall remain unaltered,” the board said in a press release.The three cricketers, were, however, hopeful of returning to the game. Sreesanth said he wanted to start training as soon as possible to get back into the selection process. “I’m very, very happy. I want to thank God,” he said. “I will try to start training properly as soon as possible, I wasn’t allowed anything. Hopefully I can get permission from BCCI to use their facilities so that I can get fit and come into the selection process.”Reacting to the court’s decision, Chandila said the period following the spot-fixing scandal was “the worst of my life”.Chavan also expressed hope of returning to the game: “So far I just know that I have been given a discharge and now I am looking forward to play cricket. So let’s see how it goes. I am taking it step by step. It was tough for me as a cricketer. It was a tough time but I got through with support from family and friends. I am sure I will be back to cricket again.”

O estilo de jogo do Furacão não alterou na segunda etapa. Em sintonia, pressão e posse de bola coroaram o primeiro gol da partida. O volante Bruno Guimarães, que já vinha apresentando bom rendimento ao longo da competição, apresentou-se para balançar a rede. Marco Ruben, que é referência no ataque foi garçom. O argentino fez duas tentativas para o camisa 39 comemorar o seu primeiro gol na Copa do Brasil.

Além do importante gol, o jogador comandou o setor de meio-campo, com 89% de passes certos. Para exaltar a importância do volante, Bruno Guimarães arriscou apenas uma vez à meta e colocou no ângulo de Marcelo Lomba.

MAIS MOBILIDADE

Antes mesmo de levar o gol, o ataque do Internacional estava bastante paralisado. Guerrero e Nico López deram pouca mobilidade no primeiro tempo. Na metade da segunda etapa, Odair sacou Wellington Silva do banco de reservas. O atacante, de forma natural, como é de suas características, deu mais movimentação. Mas ao mesmo tempo não chegou com grande frequência, porém deu preocupação para a defesa atleticana.

O Athletico-PR continuou da mesma forma, enquanto o Internacional de vez em quando, assustava. Aos 27 minutos, Rony avançou em velocidade e chutou forte para grade defesa de Marcelo Lomba. O goleiro evitou o que poderia ser o segundo gol dos paranaenses. A torcida colorada tem que agradecer ao arqueiro, que evitou uma derrota maior. Agora, a decisão vai para o Beira-Rio.

PELO EMPATE…

Para ser campeão da Copa do Brasil na próxima quarta-feira, às 21h30, no Beira-Rio, em Porto Alegre, o Athletico pode até empatar. Ao Inter, a obrigação de vencer por dois gols de diferença para levantar a taça. Vitória colorada por um gol de diferença leva a decisão do título para os pênaltis.

Convocado por Tite, Fagner desfalca o Corinthians contra o Ceará

The last three days saw barely a soul in attendance at the Premadasa Stadium, but as England Lions secured the draw they needed to take the series, England’s Test aspirants may have felt one set of eyes scanning them more keenly than any other. Graham Gooch had arrived in Sri Lanka ahead of this match, foregoing most people’s favourite cricket tour – a trip to the West Indies, with the national side.Gooch is in Colombo to measure England’s emerging talent, as the beleaguered senior team seeks fresh direction. Perched behind the bowlers’ arm for much of the game’s duration, he has passed grunts of approval and harrumphs of discontent whenever a Lions batsman has been at the crease.On the final day, Gooch’s growls were largely of the happier variety, as Sam Robson hit his third hundred of the tour – an unbeaten 147. The innings came in the most testing conditions in the match. The ball had begun to take considerable turn, and the seamers had started to extract inconsistent bounce.Robson warded off the threat of a Lions collapse in the morning and remained vigilant once the threat had passed. Perhaps suspecting England’s batting coach was watching his every move, he held the pose whenever he struck it particularly sweetly. Compact in defence, and compelling in attack, Robson prospered in the V, prompting a murmured affirmation from Gooch when he hit a searing straight drive off Vishwa Fernando.Offspinner Suraj Randiv had troubled Lions batsmen from the outset on the final day, but Robson was rarely perturbed by his accuracy, nor his extra bounce. Twice he inside edged Randiv past the stumps, but they were hardly close calls. It would not have escaped Gooch that Robson had also hit two hundreds in Australia three months ago, with England’s Performance Programme squad.To have succeeded in Perth and Colombo at 24 years of age suggests serious batting talent. The Lions’ coach Mark Robinson certainly thinks so.”Sam has to be pushing for a place in the national team,” he said. “Even in the nets, he’s got this great ability to play every ball like it’s the most important ball he’s ever had in his life. That’s a great quality, and you see it when you watch him in the middle. We’ve also seen it first hand in the county season, where his tempo stays very consistent when he’s batting.”He’s had a great innings, and what these boys need to do is back it up when they get back, but they’ll take some good form and good news back with them.”The commitmen Robson brought to his work was evident in his refusal to allow his effort to wane, even when the heat had sapped him. Even before Robson reached three figures, he was hunched over at the non-striker’s end and, as the day grew long, he would sit increasingly on his haunches between balls. Yet when he bowler reached the top of his mark, Robson would switch himself on. Tired as he was, few poor deliveries escaped punishment even late in the day.Varun Chopra hit his second fifty of the match in the third session, as Sri Lanka fizzled out, clear now that they would neither win nor lose. Lahiru Gamage bowled a spell off testing reverse swing in the afternoon, but he could not cause significant damage at his pace.Vishwa Fernando had the opposite problem, going through quickly even off the slowing surface, but unable to generate enough lateral movement to trouble the batsmen. Sri Lanka had hoped he could become the hit-the-deck left-arm cog in their pace battery, but he has not been penetrative in this series, and may require more time to develop.Although the Lions won the series, 1-0 is not a particularly disheartening result for the hosts. Sri Lanka will rarely possess the depth England boasts, and a healthy portion of this team played in their first A-team series.Most will view these matches as simply a step in their development, only, the two oldest players – Randiv and Tharanga – will just have to hope that Sri Lanka’s team management paid as much attention to this game as England’s top brass did.

Pakistan-Australia Test series set to be downsized

Australia’s Test series against Pakistan in October this year will be downsized to the minimum two matches, while the venue for the encounter is expected to be confirmed as the UAE.Despite the ICC Future Tours Programme dictating that the tour would consist of three Tests, the PCB has negotiated for the removal of one five-day match to be replaced by a series of limited-overs matches, likely to include three ODIs and a Twenty20 fixture.While the location of these matches is yet to be finalised, the loss of a Test from the fixture list is certain. This schedule is expected to bring in a more lucrative broadcast fee for the cash-pressured governing body of cricket in Pakistan, forced to subsist on series played in neutral venues since the terrorist attack on the touring Sri Lankan team in Lahore in 2009.”Our expectation will be that it will be in the UAE, and my expectation is that it won’t be three Test matches, it will probably be two Test matches and a combination of one-dayers,” James Sutherland, the Cricket Australia chief executive, told ABC Radio during the Sydney Ashes Test. “Perhaps with a view to the fact there’s a World Cup here in Australia and New Zealand in February and March 2015.”It’s the hosts’ call on that and we’ll work as closely as we can with them, there’s a reciprocal arrangement, we wouldn’t like to be playing a series of less than three but that’s their choice how they balance that, and at the end of the day, Pakistan are not able to host international cricket in Pakistan, their commercial viability is really affected by that, so we respect their position and the decisions they need to make there.”Apart from the UAE, the only other plausible venue for a Test match is Qatar, where the PCB is presently hosting a women’s tournament. However stadium facilities and infrastructure in the nation set to host the next football World Cup are not as advanced or varied as those in the UAE, with Dubai host to the ICC’s headquarters and global cricket academy.The most recent encounter between the two nations was also played over just two Tests, the “MCC Spirit of Cricket” series which took place in England in the northern summer of 2010 and was split 1-1 when Pakistan won at Headingley after Australia’s victory at Lord’s. While CA have spoken consistently of their desire for Test bouts of at least three matches’ duration, their own schedule is increasingly light on such series.Australia and Pakistan have not met in Tests since the 2010 series in England•AFP

Apart from blue-chip contests against England (five Tests) and India (four), Australia have played two-Test series against New Zealand, Pakistan and South Africa in recent times. Their next visit to the West Indies in May 2015 is also scheduled to include the bare minimum two Tests.”The programme is a real challenge, there’s no doubt for us as administrators it is one of the most difficult things we do and we often talk about it in the context of being a three-dimensional game of chess,” Sutherland said. “Unlike other sporting codes we don’t have a unilateral ability to work out what our programme might be, we have to see what’s going on in other parts of the world, what country is playing where and how. And we need to work out the international programme and then work out the best we can from the domestic programme.”

The BCCI’s disciplinary committee has found Lalit Modi, the former IPL chairman, guilty on eight different charges of “various acts of indiscipline and misconduct”. The charges, relating to irregularities in various financial and administrative matters of the IPL including the sale of franchise and media rights, were pressed by the BCCI in 2010 soon after Modi’s swift and dramatic exit from the league he founded.The 134-page report – prepared by a committee comprising senior BCCI functionaries Arun Jaitley, Chirayu Amin and Jyotiraditya Scindia – has been submitted to the BCCI and will be discussed at a special general meeting on September 25. It is believed that a life ban for Modi will be recommended and accepted at the meeting.In his reaction to the report, Modi pointed out several flaws in both the procedure and the findings. He alleged that Jaitley had a bias against him and also was the “strongest supporter” of N Srinivasan, the BCCI president. Modi said one of his main lines of defence was that the enquiry against him was “vitiated on account of malafide” because he had opposed Srinivasan’s conflict of interest as team owner and administrator. He claimed that Jaitley “did not allow any question to be put in respect of Srinivasan’s conflict of interest and virtually skirted the issue of Srinivasan’s conflict of interest in his report.” His response to the committee’s actual findings echoed his defence on the various charges.The committee found Modi guilty of rigging bids during the franchise auction in 2010, arm-twisting the Kochi franchise and threatening to terminate their franchise agreement in favour of another bidder, selling media and internet rights without proper authorisation from the BCCI and showing interest in creating a rebel T20 league in England without the knowledge of the BCCI and the ECB. In January 2008, World Sports Group India was granted global television rights for the IPL between 2008-2017 while Multi Screen Media Satellite (Singapore) pte Ltd. got the rights to telecast the matches in the Indian subcontinent between 2008-2012. On March 14, 2009, at 8 pm, the BCCI terminated its agreement with MSM on account of various “breaches”, including its failure to promote BIG TV, a ground sponsor. That left the Indian TV rights without a rights holder.At 3 am on March 15, WSG Mauritius, which had the same directors as WSG India, was granted the global and Indian broadcast rights for the IPL between 2009-2017. A fresh agreement with WSG Mauritius was entered into, under which WSG Mauritius had 72 hours to find a broadcast partner failing which the rights would revert to the BCCI. It was also expected to pay the BCCI Rs 112.5 crores as a signing fee – a sum the BCCI contended it never received.When WSG Mauritius failed to get a partner, it agreed the rights would revert back to the BCCI but WSG India would retain the global rights (excluding Indian subcontinent) till 2017. That still left the Indian rights without a rights holder.However, the BCCI contended, MSM and WSG Mauritius cut a deal while the India rights were parked with WSG so that WSG would let go of the rights; once the rights were released back to the BCCI, MSM could get them back. For this, the BCCI contended, MSM paid WSG an $80million facilitation fee – a fee the board says should have come to it. The BCCI further contended that WSG’s failure to honour the 72-hour clause, which effectively ensured it lost the rights, was only a mechanism for parking the rights till MSM came on board.Finally, the BCCI contended that all this was done with the knowledge and active participation, of Modi – who was a via media between MSM and WSG.There were three specific charges against Modi arising from this issue. First, that the agreement with WSG entered into on March 15 2009 was never intended to be performed; the report found this charge “not proved”. Second, that Modi, without any authorization of the board, did not insist on WSG repaying the Rs 112.5 crore signing fee; the committee did not agree with Modi’s defence that the payment was not insisted upon because the BCCI and MSM were in litigation, and held the charge as proved. Third, that Modi, despite knowledge of the nature and value of the facilitation agreement, obligated the BCCI to ensure its compliance vis a vis WSG Mauritius and further obligated the BCCI to make the payment if MSM defaulted – a “serious misconduct”. The committee held Modi’s defence – that neither he nor the BCCI were expected to know the nature and terms of the facilitation agreement – as “completely untenable” and held the charge as proved.Rigging bids
In 2010, the BCCI drafted an invitation to tender [ITT] for rights to two new franchises that were to be auctioned later that year. The BCCI claimed that Modi added – without formally informing the board – two “onerous conditions” to the ITT: the bidder should have a net worth of US$1bn and must provide a bank guarantee of Rs 460 crores [$100 million]. According to the BCCI, these conditions were not in the draft ITT, which was approved by the IPL Governing Council, and were added by Modi to the final document. Modi’s defence was that he had informed the then BCCI president, Shashank Manohar, verbally but the disciplinary committee concluded that Modi had acted without the authorization of the governing council. The panel reasoned that this was done to “exclude healthy competition and favour two bidders, which is evident from the fact that only two bids were received in pursuant to the ITT.”Arm-twisting franchises
The rights to the two new franchises in 2010 – Pune Warriors and Kochi Tuskers – were bought by Sahara Adventure Sports and Rendezvous Sports World Pvt Ltd respectively.The BCCI’s contention was that Modi was “favouring another bidder” and had threatened a “representative” of the Kochi franchise to give up the rights, failing which he could impose various sanctions that could harm the new entrant. The BCCI claimed that Modi’s threat was an “act of indiscipline and misconduct”.The disciplinary panel found that the charge stood against Modi because “despite being the successful bidder, Mr Modi made a roving enquiry on the ownership details of the Kochi franchise at the stage of signing the Franchise Agreement.” The report stated: “He goes out of his way in making intrusive questions about the ownership details of the Kochi franchise.” The panel said the act of arm-twisting was detrimental to the BCCI’s interest and “endangered the harmony and affected the reputation of the BCCI.”
